Jason Wesoky

At Darling Milligan Smitch & Lesch, P.C., Mr. Wesoky focuses on business litigation, real estate litigation, personal injury, and appellate work.

Mr. Wesoky has worked on a wide range of disputes, including multi-million-dollar contract disputes, class actions involving claims against pharmaceutical companies, class actions against Hewlett Packard and Wal-Mart involving wage disputes, intellectual property cases and construction defect cases.  Mr. Wesoky has appeared before several Colorado district courts, the U.S. District Courts for Colorado, California, and Minnesota, the San Diego Northern District Court and the U.S. Court of Appeals for the Tenth Circuit.  Mr. Wesoky presented oral argument and obtained reversal of the trial court’s decision in Protocols v. Leavitt, et al., 549 F. 3d 1294 (10th Cir. 2008).

Mr. Wesoky is a member of the Tenth Circuit’s Criminal Justice Act (CJA) panel, where he handles criminal appeals for indigent persons. As a member of the panel, he successfully petitioned the U.S. Supreme Court for a writ of certiorari. The Court granted the writ and vacated the ruling of the Tenth Circuit inKittredge v. U.S.

Mr. Wesoky spent two years working at Franklin D. Azar & Associates. Prior to that, he spent four years with Brownstein Hyatt Farber & Schreck. From 2004 to 2005, Mr. Wesoky served as a law clerk to the Honorable Timothy M. Tymkovich of the U.S. Court of Appeals, Tenth Judicial Circuit.  From 2002 to 2004, he was an Associate at Perkins Coie in the firm’s litigation group. While there, he worked on cases involving legal malpractice, shareholder disputes and contract issues. Prior to his time at Perkins Coie, he was an associate at Mallon and McCool, where his work included defamation, harassment and criminal cases.
